DECREE NO. 26
PENSIONS (AMENDMENT) (NO. 1) DECREE OF 1988
A DECREE TO AMEND PENSIONS ACT 1983
IN exercise of the powers vested in me as President and Commander-in-Chief of the Republic of Fiji and acting in accordance with the advice of the Prime Minister and the Cabinet, I hereby make the following Decree-
Short title
1. This Decree may be cited as the Pensions (Amendment) (No. 1) Decree of 1988.
Commencement
2. This Decree shall come into force on 1 May 1988.
Interpretation
3. In this Decree “principal Act” means the Pensions Act, 1983.
Amendment to section 6
4. Paragraph (b) of section 6 of the principal Act is amended by deleting everything appearing after the word “years” except for the full stop.
Amendment to section 7
5. Paragraphs (b) and (c) of section 7 of the principal Act are amended by deleting the words “fifty-five years” appearing in each of those paragraphs and replacing them with the words “fifty years”.
Amendment to section 9
6. Paragraph (b) of sub-section (1) of section 9 of the principal Act is amended by deleting the words “fifty-five years” and replacing them with the words “fifty years”.
Repeal of sections 11, 12, 13, 14 and 18
7. Sections 11, 12, 13, 14 and 18 of the principal Act are repealed and revoked

AMENDMENTS TO THE PENSIONS ACT 1983
OBJECTS AND REASONS
The main object of the amendment is to lower the compulsory retiring age of civil servants from the current 60 years of age to 55. This is done to bring about consistencies between the provisions of the Pensions Act 1983 and the Public Service Commission Decree of 1987.
A new feature to the amendment is the lowering of the voluntary retiring age from the current 55 to 50.
The subject matter of this Decree comes within the sphere of responsibility of the Minister of Finance and Economic Planning.
