OFFICE OF THE VICE-PRESIDENT AND SUCCESSION DECREE 2009

(DECREE NO. 8)
IN exercise of the powers vested in me as the President and Commander in Chief of the Republic of the Fiji Military Forces, I hereby make the following Decree:
1. This Decree may be cited as Office of the Vice-President and Succession Decree 2009.
2. This Decree establishes the Office of the Vice-President who shall be appointed by the President for a term of up to five years, and shall be eligible for reappointment.
3. The Vice-President performs the functions of the President if the President is absent from duty or from Fiji or is, for any other reason, unable to perform the functions of his or her office.
4. If neither the President nor the Vice-President is available to perform a function of the President, it may be performed by the Chief Justice or, in the absence of the Chief Justice, the next most senior substantive judge, determined by having regard to the date of appointment and the nature of the judicial office held.
5. Before taking office, the Vice-President must, before the President, take the Oath/Affirmation of Allegiance and the Oath/Affirmation of Office as set out in the Schedule.
