Land Transport (Amendment) Decree 2012

GOVERNMENT OF FIJI

LAND TRANSPORT (AMENDMENT) DECREE 2012
(DECREE NO. 74 OF 2012)

IN exercise of the powers vested in me as the President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009, I hereby make the following Decree—

TO AMEND THE LAND TRANSPORT ACT 1998

Short title and commencement

1. This Decree may be cited as the Land Transport (Amendment) Decree 2012 and shall come into force on the date of its publication in the Gazette.

Section 103 amended

2. The Land Transport Act 1998 is amended in section 103 by inserting the following new subsection after subsection (1)—

"(1A) A person fails to undergo a breath test or breath analysis if that person does not provide a specimen of breath which—

(i) is sufficient to enable the test or the analysis to be carried out; and

(ii) is provided in such a way as to enable the objective of the test or analysis to be satisfactorily achieved."
