LAND TRANSPORT AUTHORITY (AMENDMENT) DECREE 2009

(DECREE NO. 17)

IN exercise of the powers vested in me as the President of the Fiji Islands and Commander in Chief of the Republic of Fiji Military Forces, I hereby make the following Decree—

TO AMEND THE LAND TRANSPORT ACT 1998

Short title and commencement

1. This Decree may be cited as the Land Transport Authority (Amendment) Decree and comes into force on the 5th of May 2009.

Section 57 amended

2. Section 57 of the Land Transport Act 1998 ("the Act") is amended by adding the following new subsection after subsection (3)—

"(4) A person who is a holder of a provisional driving license on the date this Part comes into force shall be required to attend and participate in a formal Course and program in defensive driving and road safety conducted or approved by the Authority before the full driver's license is issued."

Section 59 amended

3. Section 59 of the Act is amended by adding after subsection (14), the new subsection—

"(15) If a person has committed 5 or more traffic offences or is disqualified from holding or obtaining a driver's license for 3 months or more, he or she shall be required to attend and participate in a formal course and program of instruction in defensive driving and road safety approved by the Authority."
