LOCAL GOVERNMENT ACT (AMENDMENT) DECREE 2009

GOVERNMENT OF FIJI
(DECREE NO. 12)

IN exercise of the powers vested in me as the President and Commander in Chief of the Republic of the Fiji Military Forces, I hereby make the following Decree:

Short title and commencement

1. This Decree may be cited as the Local Government Act (Amendment) Decree 2009, and shall be deemed to come into force on 15th April 2009.

Section 35 amended

2. Section 35 of the Local Government Act [Cap. 125] is amended by inserting the following new subsections after subsection (4):

"(5) A person appointed under this section shall retire or be retired at the age of 60 years.

(6) Nothing in subsection (5) shall prevent, upon retirement, the re-engagement of a person on a fixed term contractual appointment, if his or her services are required by a council; Provided however, that no retired person may be re-engaged by a council until approval has first been obtained from the Permanent Secretary for the Ministry responsible for Local Government."
