Liquor (Amendment) Decree 2011

LIQUOR (AMENDMENT) DECREE 2011
(DECREE NO. 25 of 2011)

IN exercise of the powers vested in me as the President of the Republic of Fiji and Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009, I hereby make the following Decree -

TO AMEND THE LIQUOR ACT 2006

Short title and commencement

1. This Decree may be cited as the Liquor (Amendment) Decree 2011 and shall come into force on 10th May, 2011.

Section 5 amended

2. Section 5 of the Liquor Act 2006 is amended –

(a) by deleting subsection (1) and substituting -

"(1) There is hereby constituted a Divisional Liquor Licensing Authority in respect of each Division in Fiji, each of which shall consist of

(a) a Chairperson who is appointed by the Minister;

(b) the Divisional Commissioner or his nominee;

(c) the Solicitor-General or his nominee;

(d) 2 other members who are normally resident in the Division who are appointed by the Minister."

(b) by deleting subsection (2) and substituting -

"(2) Subject to subsection (3), each member shall be appointed for a term of three years (subject to earlier termination by the Minister) and shall be eligible for reappointment."

(c) by inserting a new subsection (3) after subsection (2) -

"(3) The Divisional Commissioner or his nominee and the Solicitor-General or his nominee shall continue as members for as long as they hold their respective Offices, provided that the appointments of nominees shall be at the discretion of the Divisional Commissioner and the Solicitor-General respectively.

(d) by renumbering subsection "(3) as subsection "(4) and subsection "(4)" as subsection "(5)".
