Income Tax (Amendment) Decree 2011

INCOME TAX (AMENDMENT) DECREE 2011
(DECREE NO. 37 OF 2011)

IN exercise of the powers vested in me pursuant to section 4 of the Office of the Vice-President and Succession Decree 2009 (Decree No. 8 of 2009) I hereby make the following Decree—

TO AMEND THE INCOME TAX ACT

Short title and commencement

1.—(1) This Decree may be cited as the Income Tax (Amendment) Decree 2011 and shall come into force on the date of its publication in the Gazette.

(2) The Income Tax Act is referred to as the "Principal Act".
Eleventh Schedule amended

2. The Principal Act is amended in the Eleventh Schedule—

(a) in paragraph 2 by inserting the following definition— "integrated tourism development" must include the development of a hotel and the subdivision and sale of residential lots and include, but not limited to the development of jetties, moorings, recreational facilities and other amenities.

(b) in paragraph 10 (3), by—

(i) inserting in sub paragraph (c) the words "or integrated tourism development" after "hotel accommodation";

(ii) deleting sub paragraph (e) and substituting—"(e) whether the proposed, hotel or integrated tourism development is a suitable size and standard for the area concerned";

(c) in paragraph 12(1) by inserting a new sub paragraph (q) "(q) The project must provide evidence that proceeds from the sale of lots which form part of the integrated tourism development is reinvested in that project."

(d) in paragraph 26 by inserting—

(i) "(1)" in between "26" and "Any";

(ii) a new sub paragraph 26(2)—"26 (2) – Any integrated tourism development investment may be granted an approval under this Schedule commencing from the 6th April, 2009."

(e) subject to paragraph (c), by inserting the words "or integrated tourism development" after "hotel", wherever it appears.
