INTERIM CIVILIAN GOVERNMENT (CONSEQUENTIAL AMENDMENTS)
DECREE 2000
(INTERIM CIVILIAN GOVERNMENT DECREE NO. 21)
IN exercise of the powers conferred upon the Interim Civilian Government by section 4 of the Interim Civilian Government (Transfer of Executive Authority) Decree No. 19 of 2000, I, Josefa Iloilovatu Uluivuda, President of the Republic of Fiji, acting on the advice of the Cabinet, hereby make this Decree to make consequential amendments to the Decrees promulgated by the Interim Military Government.
Short title
1. This Decree may be cited as the Interim Civilian Government (Consequential Amendments) Decree 2000.
Consequential amendments
2.-(1) The provisions of the Decrees made by the Interim Military Government are amended or repealed as set out in the Schedule.
(2) References to "Executive Council" in Decrees made by the Interim Military Government are to be read as references to "Cabinet".

Emergency Decree No.4 of 2000 | (a) Section 1 – after "extended" insert "by the Minister". (b) General amendment – Substitute "Head of the Military Government" with "Minister" wherever it appears in the Decree. |
State Services Decree No.6 of 2000 | (a) Substitute "Head of the Military Government" with "President" as appearing in sections 2, 5, 8, 10, 11, 13, 14, 16, 17, 23 and 25. (b) Substitute "Head of the Military Government" with "Prime Minister" as appearing in sections 3 and 19. (c) Section 9(1) – Repeal paragraphs (a), (b) and (c) and substitute the following- "(a) the Chairperson of the Public Service Commission as the Chairperson; (b) the President of the Fiji Law Society; and (c) a member appointed by thePresident." (d) Insert the following new section- "Republic of Fiji Military Forces 16A. – (1) The military force called the Republic of Fiji Military Forces established by the Consitutiton of 1990 continues
in existence. (2) The President, acting on the advice of the Minister, must appoint a Commander of the Republic of Fiji Military Forces to exercise
a military executive command of the Forces, subject to the control of the Minister. (3) The Commander of the Republic of the Fiji Military Forces is responsible for: (a) making appointments of members of the Forces; (b) taking disciplinary action against members of the Forces; and (c) removing members from the Forces." (e) Repeal the definitions of "Executive Council" and "Head of the Military Government" in section 27 and insert the following definition- " "President" means the Interim President appointed under section 2 of the Interim Civilian Government (Transfer of Executive Authority)
Decree No.19 of 2000;". (f) Repeal section 27(4). |
Fundamental Rights and Freedoms Decree No.7 of 2000 | (a) Section 23(2) – delete "Head of the Military Government and insert "President". (b) Section 24 – repeal definition of "Head of the Military Government" and insert the following definition- " "President" means the Interim President of the Republic of Fiji appointed under section 2 of the Interim Civilian Government (Transfer
of Executive Authority) Decree No.19 of 2000;". (c) Repeal section 24(2). |
