AN ACT

TO AMEND THE HIGHER SALARIES COMMISSION ACT

ENACTED by the Parliament of the Fiji Islands

Short title etc

1. (1) This Act may be cited as the Higher Salaries Commission (Amendment) Act 2002.

(2) In this Act, the principal Act refers to the Higher Salaries Commission Act (Cap. 2A).

Composition of the Commission

2. Section 4 of the principal Act is amended by repealing subsection (1) and substituting the following-

"(1) The Commission shall consist of 5 members namely

(a) a Chairperson;

(b) the Permanent Secretary for Finance; and

(c) three other members who have recognized experience in economic, financial, industrial or commercial matters.

(1A) The Chairperson referred to in subsection 1(a) and 3 other members referred in subsection (1)(c) are to be appointed by the Minister.".

Functions of the Commission

3. Section 11 of the principal Act is amended by-

(a) repealing paragraph (c) and substituting the following paragraph-

"(c) to consider and determine-

(i) the salary of every Permanent Secretary or other officer who manages a department for which a Minister has responsibility;

(ii) the salaries of holders of other constitutional offices (other than persons referred to in paragraphs (a) to (f) of section 169 of the Constitution).";

(b) by inserting the following new subsections-

"(4) Whenever the Commission is considering the salaries or other allowances of every Permanent Secretary, the Permanent Secretary for Finance must not take part in the deliberations of the Commission.

(5) The Minister may, by order in the Gazette, amend the First Schedule.".

Consequential amendments

4. The principal Act is amended by deleting Chairman and substituting Chairperson wherever it appears in the following sections 4(3) and (7).

First Schedule

5. The First Schedule is repealed and substituted by the following Schedule-
