AN ACT
TO AMEND THE HIGH COURT ACT IN RESPECT OF THE NUMBER OF PUISNE JUDGES
ENACTED by the Parliament of the Fiji Islands-
Short title
1. This Act may be cited as the High Court (Judicial Establishment Amendment) Act 1999.
Amendment of section 5 of the High Court Act
2. Section 5 of the High Court Act (Cap 13) is amended-
(a) by numbering the existing text as subsection (3);
(b) by inserting before subsection (3) the following new subsections-
"(1) Subject to subsection (2), the number of puisne judges prescribed for the purpose of section 126(1) of the Constitution is 12.
(2) An appointment to fill a vacancy in the number of puisne judges above 10 only needs to be made if the Judicial Service Commission is satisfied that it is required to enable the High Court effectively to despatch its business.".
Repeal of Act No. 6 of 1997
3. The Prescription of Judges Act 1997 is repealed.
Passed by the House of Representatives this 30th day of November 1999.
Passed by the Senate this 14th day of December 1999.
