Gaming (Amendment) Decree 2012

GAMING (AMENDMENT) DECREE 2012
(DECREE NO. 24 OF 2012)

IN exercise of the powers vested in me as the President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009, I hereby make the following Decree –

TO AMEND THE GAMING DECREE 2009

Short title and commencement

1. This Decree may be cited as the Gaming (Amendment) Decree 2012 and shall come into force on the date of its publication in the Gazette.

Section 5 amended

2. Section 5 of the Gaming Decree 2009 is amended -

(a) in subsection (1) by inserting after the word "prohibited", "unless such purchase, possession or use of a gaming machine is authorised under a licence issued by the Minister under subsection (6).", and deleting the rest of that sentence;

(b) by renumbering subsections (2), (3) and (4) as subsections (3), (4) and (5) respectively;

(c) by inserting a new subsection (2) after subsection (1) as follows-

"(2) Notwithstanding subsections (1) and (6), the purchase, possession or use of a vending machine which dispenses lottery tickets upon insertion of money or money's worth in the form of cash or tokens is permitted.";

(d) in subsection (3) by deleting the full-stop at the end of the sentence and inserting "except under a licence issued by the Minister under subsection (6).";

(e) in subsection (4) by deleting the words "subsection (4)" and substituting "subsections (5) and (6)"; and

(f) by inserting a new subsection (6) after subsection (5) as follows -

"(6) The Minister shall have the power to issue an exclusive licence for casino games."
