FIJI NATIONAL TRAINING (AMENDMENT) ACT 1993


No. 12 of 1993


AN ACT


TO AMEND THE FIJI NATIONAL TRAINING ACT


ENACTED by the Parliament of Fiji


Short title


1. This Act may be cited as the Fiji National Training (Amendment) Act, 1993 and shall come into force on the day of the assent.


New section 27A


1. The Fiji National Training Act, is amended by inserting the following Section after Section 27:


"Further powers of Court


27A Where any person is convicted under the provisions of Section 19, the Court by which that person is so convicted may, without prejudice to the provision of Section 30, order the defendant to pay to the Council the amounts required to be paid under a levy order and the Court Order may also require the payment of interest on those amounts."

OBJECTS AND REASONS


(These do not form part of the Act and are intended only to indicate its general effect)


1. Since the establishment of the Fiji National Training Council under the Fiji National Training Act in 1973, the Council had encountered difficulties in recovering outstanding levies from defaulting employers. The Council has identified that Section 30 of the Act which imposes a penalty of a fine not exceeding $500.00 or imprisonment to one year or both against offenders as limiting the effectiveness of the Act. The Bill proposes to increase the powers of the Court in dealing with any convicted person so that it may, without prejudice to Section 30, order the defendant to pay to the Council the amounts required to be paid under a levy order that may be issued by the Council together with interest thereon.


2. The subject matter of this Bill falls within the sphere of responsibility of the Minister for Labour and Industrial Relations.
