Fiji Constitutional Process (Adoption of Constitution) Decree 2013

FIJI CONSTITUTIONAL PROCESS (ADOPTION OF CONSTITUTION) DECREE 2013

(DECREE NO. 12 OF 2013)

IN exercise of the powers vested in me as President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009, I hereby make the following Decree—

Short title and commencement

1. This Decree may be cited as the Fiji Constitutional Process (Adoption of Constitution) Decree 2013 and shall come into force on the date of its publication in the Gazette.

President to refer the draft constitution to the people

2.—(1) Notwithstanding anything contained in the Fiji Constitutional Process (Constitution Commission)Decree 2012 and the Fiji Constitutional Process (Constituent Assembly and Adoption of Constitution) Decree 2012,the President shall, upon receipt of the draft Constitution from the Constitution Commission and after making such changes to the draft Constitution in consultation with the Prime Minister as the President considers necessary, publish the draft Constitution in the Media.

(2) The President shall allow a period of time as the President deems necessary to receive written submissions on the views of the people on the draft Constitution.

Adoption and assent

3.—(1) Upon receipt of written submissions in section 2(2), the President shall, in consultation with the Prime Minister make such changes as he considers necessary to the draft Constitution.

(2) The President shall assent to the Constitution and a public ceremony shall take place at which the President shall display the new Constitution to the persons present and to the nation by means of television and other media.

Repeal

4.—(1) The Fiji Constitutional Process (Constituent Assembly and Adoption of Constitution) Decree 2012 is revoked.

(2) Any reference in any written law relating to the Constituent Assembly established in the Fiji Constitutional Process (Constituent Assembly and Adoption of Constitution) Decree 2012 is revoked.
