EXECUTIVE AUTHORITY OF FIJI (AMENDMENT) DECREE 2009

(DECREE NO. 28)

IN exercise of the powers vested in me as the President of Fiji and Commander in Chief of the Republic of Fiji Military Forces, I hereby make the following Decree—

Short title and commencement

1. This Decree may be cited as the Executive Authority of Fiji (Amendment) Decree 2009 and shall come into force on 28th July 2009.

New section 3A inserted

2. The Executive Authority of Fiji Decree 2009 (Decree No. 2) is amended by adding the following new section after section 3—

"3A.—(1) If the Office of the President becomes vacant, the Chief Justice, acting on the advice and nomination of the Cabinet, shall appoint another person to become President.

(2) In advising the Chief Justice under subsection (1), Cabinet shall ensure that the person nominated to be appointed as the President must be a citizen who has had a distinguished career in any aspect of national or international life, whether in the public or private sector.

(3) The person appointed as President under this section shall hold office for 3 years and is eligible for re-appointment.

(4) Before taking office, the person appointed under subsection (1) must make before the Chief Justice the Oath or Affirmation of Allegiance and the Oath or Affirmation, as set out Schedule 2."

Schedule amended

3. The Schedule to the Executive Authority of Fiji Decree 2009 (Decree No. 2) is amended by renaming it as "SCHEDULE 1".

New Schedule 2 inserted

4. The Executive Authority of Fiji Decree 2009 (Decree No. 2) is amended by inserting the following new Schedule after Schedule 1—

"SCHEDULE 2

OATH/AFFIRMATION OF ALLEGIANCE

I, being appointed President, do (swear/solemnly affirm) that I will be faithful and bear true allegiance to the Republic of Fiji, according to law. So help me God*

OATH/AFFIRMATION FOR DUE EXECUTION OF THE OFFICE

I, being appointed President, do (swear/solemnly affirm) that I will well and truly serve the Republic of Fiji in the Office of the President. So help me God.*

(* To be omitted in affirmation)"
