CRIMINAL PROCEDURE (AMENDMENT) DECREE 2014
(DECREE NO. 12 OF 2014)

IN exercise of the powers vested in me as the President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009 and section 165(2) of the Constitution of the Republic of Fiji, I hereby make the following Decree—

A DECREE TO AMEND THE CRIMINAL PROCEDURE DECREE 2009

Short title and commencement

1. This Decree may be cited as the Criminal Procedure (Amendment) Decree 2014, and shall come into force on the date of its publication in the Gazette.

Section 248 amended

2. Section 248 of the Criminal Procedure Decree 2009 is amended by—

(a) deleting in subsection (1), paragraphs (a) and (b) and substituting with the following paragraphs—

“(a) it shall be filed at the Registry of the High Court;

(b) a copy of the petition shall be served on the Magistrates Court from the decision of which the appeal is lodged; and” and

(b) deleting in subsection (2), the words “Magistrates’ Court or the” before the words “High Court”.
