ORDER OF THE COURT

The Court having considered the arguments carefully presented by Mr Preston, Senior Counsel for the appellant, is in agreement with the interpretation placed upon s.5 of the Local Government Act (now Cap. 125) by the Court of Appeal. The Court does not consider it necessary to add to the reasons given by the Court of Appeal for reaching this conclusion.

The order of the Court is that the appeal is dismissed with costs.
