Regina v Kumar [1979] FJSC 13; Criminal Case 3 OF 1979 (4 June 1979)

IN THE SUPREME COURT OF FIJI
(WESTERN DIVISION)
AT LAUTOKA
Criminal Jurisdiction

Criminal Case No. 3 of 1979

REGINA

v

YATISH KUMAR alias BROTIER
s/o Dharam Raj

Mr. S.R. Shankar, Counsel for the Accused
Mr. D. Williams, Counsel for the Prosecution

SENTENCE

The complainant in this case was 10 years of age, a slightly built female as is indicated by the fact that accused picked her up and carried her.

Fortunately no damage physically was done to the child and one should, in the accused's favour, take the view that he did not press home his attempt.

The area chosen by accused was certainly not remote and the attack appears to have been almost inexplicable.

Young children must be protected and the lowest sentence I can pass is 30 months' imprisonment.

(sgd)(J.T. Williams)
JUDGE

LAUTOKA,
4th June, 1979
