O R D E R


  1. It has been brought to my attention that in the judgment in this matter by Abeygunaratne J on 3rd February 2016 at paragraph 14 a citation had been made of a New Zealand case which was made in unknowing breach of a suppression order made by the judge [Ellis J] in that case.
  2. The Fiji court had not been advised that a suppression order had been made in the New Zealand case properly to be cited “SM v LFDB”.
  3. The judge in the Fiji case has now left Fiji. In the circumstances, there being no relevant reason for taking a different view on the suppression order, I order that the Fiji judgment be redacted and that paragraph 14 of the judgment –

M v DB


(ii) At page 6, line 12, the citation to be removed and replaced with the citation:

M v DB [2012] NZHC 1152


(iii) The High Court Registry at Lautoka is to ensure necessary steps are taken to correct the judgment on the Judiciary website and on PACLII within the next 7 days.
