Batimudramudra v State [2015] FJHC 395; HAM053.2015S (22 May 2015)
IN THE HIGH COURT OF FIJI
AT SUVA
MISCELLANEOUS JURISDICTION
MISCELLANEOUS CASE NO. HAM 053 OF 2015S
JALESI BATIMUDRAMUDRA
vs
THE STATE
Counsels : Accused in Person
Mr. T. Qalinauci for State
Hearing : 8 May, 2015
Ruling : 22 May, 2015
BAIL RULING
- On 21 April 2015, the accused applied for bail. This is his third bail application. In his first bail application, in Miscellaneous
Case No. HAM 144 of 2013S, I dismissed his bail application. A copy of that decision is attached to this ruling, for ease of reference.
I also denied his second bail application in Miscellaneous Case No. HAM 012 of 2014S, on the ground that while High Court Criminal
Case No. HAC 115 of 2013S was pending, he absconded from custody from 9 May 2014 to 1 August 2014, approximately 3 months.
- The issue in this third bail application is whether or not the circumstances had changed, to enable the court to grant bail to the
accused. I repeat the laws on bail in my earlier bail rulings. I have carefully read and considered the accused's bail application
contained in the bail application form dated 21 April 2015, and his letter attached thereto dated 17 April 2015. I have also carefully
considered DC 3722 Munilesh's affidavit in reply, filed on 24 April 2015. In my view, the circumstances had not changed, and the
accused's bail is denied.
