JUDGMENT OF THE COURT


[1] Gyan Wati, you are charged with the following offence:


Statement of Offence


COUNSELLING MURDER: contrary to sections 45 and 237 of the Crimes Decree 2009


Particulars of the Offence


GYAN WATI on the 28th April 2010, at Labasa in the Northern Division, counselled Saula Rokobukai Jr. to murder Sushila Devi, and the said Saula Rokobukai Jr. did murder the said Sushila Devi on the 29th April 2010.


[2] After trial, the three assessors have found you not guilty of the offence. That verdict is available on the evidence if they do not accept the evidence of your confidante Poonam or the evidence in the cautioned interview. In directing myself in my own summing up, I have no cause to disagree with them and I find you not guilty. You are acquitted of the charge.
