SENTENCE


[1] I am satisfied that the accused has freely and voluntarily pleaded guilty. I convict him on his plea of guilty on the charge of being in possession of an illicit drug. The quantity of drug, namely, marijuana is 1.7 grams. The drug was for personal use.


[2] The accused is a first time offender, aged 43 years and married with two children. His family is depended on him.


[3] In the circumstances, a fine is appropriate. I am satisfied the accused has means to pay a fine. The accused is sentenced to pay a fine of $100.00 to be paid within 21 days in default 3 months imprisonment.


[4] The case is adjourned to 3rd October, 2008 at 9.30am to check on the payment of fine. Drugs are to be destroyed within 7 days.
