ORAL JUDGMENT OF FINNIGAN J


Mr Sahu Khan appears today for the Respondent but there is no appearance for the Appellant. Mr Sahu Khan advises that after filling the appeal the Appellant has shown no interest in the matter. Appellant is represented by the Legal Aid Commission.


On the basis that the Appellant has taken no interest in the appeal even though assisted by Counsel from the Legal Aid Commission, and on the basis of his non appearance today this appeal is struck out on the Respondent’s application. Costs to the Respondent summarily assessed at $500.00.
