  1. The appeal is allowed on the basis that section 28(1)(d) of the Constitution of Fiji Islands has not been complied with and the State concedes that the plea is equivocal.
  2. The matter is remitted to the Lautoka Magistrates Court on 19th November 2004 for re-hearing before another magistrate.
