State v Prasad [2004] FJHC 215; HAM0034D.2004S (18 June 2004)

IN THE HIGH COURT OF FIJI
AT SUVA
MISCELLANEOUS JURISDICTION

MISC. CASE NO: HAM0034 OF 2004S

Between:

THE STATE
Applicant

And:

LALTA PRASAD
Respondent

Hearing: 18th June 2004
Ruling: 18th June 2004

Counsel: Mr. D. Prasad for State
Respondent in Person

RULING

This matter is referred to the High Court for sentence. He now asks for bail to instruct a lawyer. The record shows that he has had ample opportunity to instruct a lawyer and has not done so.

I have now adjourned the sentencing of the accused to the 21st of June 2004. He may instruct a lawyer before then and the lawyer, if instructed can move the court for a further adjournment on the 21st.

The accused is now convicted and has no right to bail. No delay is anticipated in the sentencing of the accused and a custodial sentence on the basis of guideline cases is likely. The application for bail is refused.

Nazhat Shameem
JUDGE

At Suva
18th June 2004
