ORDER


UPON HEARING T. Fa, counsel for the Plaintiff and S. Matawalu, counsel for the Defendants


IT IS ORDERED THAT:-


  1. Leave be granted to the Defendants to file an affidavit to answer to the affidavit filed by the Plaintiff by midday 23 July 2002; and
  2. That the hearing of the Originating Summons filed on 19 July 2002 and the Summons to strike out filed on 22 July 2002 take place on Thursday 25 July 2002 at 2.15 p.m.

In the circumstances of this case which involve contested custody of 2 children aged 8 and 22 years allegedly wrongfully removed from Tonga:


  1. The Commissioner of Police is requested to provide a suitable police presence at the hearing of the application; and
  2. The Director of Social Welfare is to be advised of the pendency of this action and is requested to send a representing officer to the proceedings.
