SAVENACA WAQATABU

Mr K. Tunidau for State

Accused in Person

Hearing: 20th July 2001

Ruling: 20th July 2001

RULING

This is an application for bail pending appeal. The appeal hen adjourned to 30th July 2001 due to the fact that the Appellant said his counsel was unav unavailable. It now transpires that he has not instructed counsel and the appeal could have been heard at 9.30 a.m. as designated.

However after considering the evidence of Captain Veer Chand of the Salvation Army and his submissions, and havinrd counsel for the State, Ite, I am satisfied that this is not one of the exceptional cases where bail pending appeal should be granted.

The Appellant has only a few days to the hearing of the appeal, the sen is a long one and there does not appear to be an obvious prospect of success. This applicaplication is refused.
