Fiji Islands - In re Sikeli Kalisito - Pacific Law Materials

IN THE HIGH COURT OF FIJI

(AT SUVA)

REVISIONAL JURISDICTION

MISCELLANEOUS PROCEEDINGS NO. HBM 045/00

IN THE MATTER OF

SIKELI KALISITO

Ms. V. Qionibaravi for the Applicant

Ms. Racheal Olutimayin for the Director of Public Prosecutions

JUDGMENT

The Applicant is a mini bus driver who is serving a substantial term of imprisonment in default of payment of a large number of small fines for relatively minor traffic offences.

As explained in Eroni Delai (HBM 15/2000) and Savenaca Komai (BM 40/2000) the accumulation of short terms of imprisonment in this way is absolutely wrong.

Each of the sentences imposed on the Applicant is to be varied to enable his immediate release.
