Background
4. For the sake of convenience that provision is set out as follows:-
218.—(1) A party to the proceedings may apply to the Tribunal to have the proceedings transferred to the Court for the hearing
and determination of the matter.
br>(2) The Trhe Tribunal may order the transfer of the proceedings to the Court if the Tribunal is of the opinion that—
(a) an important question of law is likely to arir
(b) th60;the casof such a naturnature and of such urgency that it is in the public interest that it be transferred to the Court.
(3) If the Tribunal declines to transfer proceedings to the Court, the party concerned may seek special leave of the Court for an
order that the proceedings be transferred to the Court and the Court must apply the criteria that govern the Tribunal’s decision
under subsection (2). >
(4) An ordn order for transfer of proceedings to the Court under this section may be made subject to any conditions as the Tribunal
or Court may impose.
) If derorder for transfer sfer is made under subsection (2), the Court may, if it considers that the proceedings were not properly
terred, order that the Tribunal adjudicate on the proceedings at the first instance.
Section 236 of the Act
The Tribunal or the Court in proceedings may order a party to pay to any other party costs and expenses (including expenses of witnesses) as it thinks reasonable, and may apportion the costs between the parties or any of them as it thinks fit, and may at any time vary or alter the order in the manner as it thinks reasonable.
Decision
The Tribunal Orders that the Grievor pay to the Employer, costs in the sum of $1500.00, within 21 days hereof.
