CONSENT DECISION


Mr. Jone Tivikea the Applicant raised a grievance against Amanuca Island Resort the Respondent and it was heard at Mediation Services in Nadi on 30th April 2009. The matter was not resolved and was referred to the Employment Tribunal for adjudication on 19th May 2009.


The parties first appeared before the Tribunal on 9th June 2009 and at subsequent appearances were advised and encouraged to explore prospects for further social dialogue. Consequently, at the call for mention held on 4th November, the Tribunal was advised that the grievance has been resolved and that a Memorandum of Agreement was being developed.


The Memorandum of Agreement which is attached was signed by the parties on 5th November 2009 and witnessed by the Divisional Labour Officer (Central Eastern).


The Memorandum of Agreement is endorsed as a binding decision by the Tribunal under section 210(2) of the Employment Relations Promulgation 2007.
