DECISION
This is a dispute between the National Union of Factory and Commercial Workers (the Union) and Biscuit Company of Fiji Ltd (the Employer) concerning the dismissal of Mr Narendra Prasad (the worker).
The Dispute was referred to the Tribunal on 25 September and subsequently listed for first mention on 3 October 2008.
On that day the Tribunal gave directions for the filing of preliminary submissions by the parties and the Dispute was listed for further mention on 7 November 2008.
On 7 November 2008 the Tribunal directed by consent that the name of the Employer be amended from Flour Mills of Fiji to Biscuit Company of Fiji Ltd. At the request of the parties the Dispute was placed in the list of matters to be called over on 14 November 2008 for the purpose of fixing a hearing date.
On 14 November 2008 the parties informed the Tribunal that there were outstanding interlocutory matters and as a result the Dispute was removed from the callover list and relisted for mention on 5 December 2008.
When the Dispute was called on 5 December 2008, the parties informed the Tribunal that the Dispute had been settled.
A signed agreement dated 4 December 2008 was filed on 5 December 2008.
As a result the signed settlement Agreement dated 4 December 2008 has been endorsed as a binding decision of the Tribunal pursuant to section 210 (2) of the Employment Relations Promulgation 2007.
A copy of the signed and endorsed Agreement is attached to this decision. There was no order sought as to costs.
