ORDER


Leave to appeal allowed on ground that the Magistrate failed to hold a trial within a trial in respect of the caution interview and statement of the appellant.


Leave to appeal all other grounds refused and the appeal on those grounds dismissed under section 35 (2).


Respondent to file submissions within 2 months and appellant to have one month thereafter to file any submission in reply.


Case to be listed in the July sitting of the Court.
