Arbitration Tribunal of Fiji |
THE REPUBLIC OF THE FIJI ISLANDS
NO 53 OF 2007
AWARD OF
THE ARBITRATION TRIBUNAL
INTERPRETATION AWARD OF
THE ARBITRATION TRIBUNAL
IN THE DISPUTE BETWEEN
HOT BREAD KITCHEN EMPLOYEES TRADE UNION
AND
HOT BREAD KITCHEN
HBKETU: Mr M Niumataiwalu
Hot Bread: Mr J Bale
RULING
In Award No 34 of 2007 dated 21 June 2007 the Tribunal settled a dispute between the Hot Bread Kitchen Employees Trade Union (the Union) and Hot Bread Kitchen (the Employer) concerning the Union’s Log of Claims 2004.
The Tribunal made a consent award in accordance with the terms of a signed agreement filed with the Tribunal on 6 June 2007 which was attached to the Award.
By letter dated 18 July 2007 the Union wrote to the Tribunal concerning some misunderstandings which had arisen in relation to the consent award.
As a result the correspondence was treated by the Tribunal as an application for an interpretation of the Award under section 27 of the Trade Disputes Act Cap 97.
The matter was listed for mention on 23 July 2007. As there was no appearance by the Employer, the application was relisted for mention on 27 July 2007. On that day the Union formally applied to withdraw the application and the Employer consented to that course of action.
CONSENT RULING
The application set out in the Union’s letter dated 18 July 2007 is withdrawn and the proceedings before the Tribunal are discontinued.
DATED at Suva this 30 day of July 2007
Mr. W. D. Calanchini
