An Act to amend the Marine Resources Act 1989

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled and by the authority of the same as follows:

1. Short Title - This Act may be cited as the Marine Resources Amendment Act 1991 and shall be read together with and deemed part of the Marine Resources Act 1989 (hereinafter referred to as "the principal Act").

2. Access agreements - Section 13(2) of the principal Act is amended by inserting the word "shall" after the words "and" and before the word "be".

3. Driftnet Fishing Activities - Section 15(4) of the principal Act is amended by deleting the words "Cook Islands National" and substituting them with the following "Cook Islander".

4. Cancellation or suspension of fishing licences - Section 23(8) of the principal Act is amended by deleting the figure "1" and substituting it with the figure "4".

5. Prohibited Fishing methods - Section 26(1)(b) of the principal Act is amended by deleting the full stop "." after the words "paragraph (a)".

6. Powers of authorised officers between limits of fished waters - Section 32 of the principal Act is amended by deleting the words "section 3(2)(d)"and substituting them with the words "section 31(2)(c)".

7. Removal of parts from seized vessels, etc. - Section 34(1) of the principal Act is amended by deleting the word "immobilising" and substituting it with the word "immobilising".

8. Courts Power of forfeiture - Section 43 of the principal Act is amended by deleting the figures "4(3)" and "4(2)" and substituting them with the figures "40(1)" and "40(3)" respectively.

9. Removal of item in custody - Section 49 of the principal Act is amended by inserting after the words "is liable" and before the words "to a" the words "on conviction".

10. Jurisdiction of the High Court - Section 50(5) of the principal Act is amended by deleting the following words ("Criminal Proceedings Act)" together with the parenthesis and substituting them with the following words "any statutory enactment" after the words "provision of" and before the words "an information".

11. Observer devices - Section 56 (9) of the principal Act is amended by inserting on the fifth line after the words "an observer" and before the word "machine" the words "device or".
