An Act to amend the Cook Islands Amendment Act 1957

[24 December 1968

BE IT ENACTED by the Legislative assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:-

1. Short Title - This Act may be cited as the Cook Islands Amendment Act 1968 and shall be read together with and deemed part of the Cook Islands Amendment Act 1957 (hereinafter referred to as "the principal Act").

2. Certain sections amended - Sections 22, 23, 24 and 25 of the principal Act are hereby amended by omitting the words "Chief Medical Officer" wherever they occur, and substituting the words "Director of Health".

3. Duties of Director of Health of the Cook Islands - Section 24 of the principal Act is hereby amended by omitting subsection (3), and substituting the following subsections:

"(3) Where damage is suffered by any person as e result of any wilful or negligent act or omission of any Medical Officer or of any graduate of the Central Medical School at Suva, Fiji, who is duly authorised to practise medicine and surgery in the Cook Islands, and who is a member of the Cook islands Public Service and is acting in the course of his or her employment, an action in respect of the damage shall lie against the Crown by or on behalf of the person suffering the damage, and in any such case the Crown shall be liable in the same manner and to the same extent as if the damage had been caused by an act or omission of a servant of the Crown acting in the course of his or her employment.

(4) Nothing in this section shall be deemed to affect any right of action against the person guilty of the act or omission complained of."
