An Act to amend the Airport Authority Act 1985

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:

1. Short Title - This Act may be cited as the Airport Authority (Amendment) Act 2007 and shall be read together with and deemed part of the Airport Authority Act 1985 (hereinafter referred to as "the principal Act").

2. Board of Directors - (1) The principal Act is amended by repealing section 4 and substituting the following new section-

"4. Board of Directors - (1) There shall be a Board of Directors of the Authority consisting of-

(a) not less than three nor more than five voting members to be appointed by the Board of the Corporation, one of who shall be appointed by the Board of the Corporation as chairman, and at least one of whom shall be appointed as representative of all islands other than the island of Rarotonga; and

(b) two ex-officio members of the Board being the Chief Executive Officer of the Airport Authority and the Director of Civil Aviation or, if the Director of Civil Aviation is not present in the Cook Islands, the Deputy Director.

(2) No person by reason only of being a director of the Authority shall be deemed to be employed in the Public Service within the meaning of the Public Service Act 1995-96."

3. Savings - Notwithstanding the repeal of Section 4 of the principal Act, by this Act, and without limiting the provisions of the Acts Interpretation Act 1924, every appointment made pursuant to that section shall continue in force as if that appointment was made pursuant to section 4 of the principal Act as inserted by section 2 of this Act.
