Police v Bevin [2019] CKHC 38; CR 259 of 2019 (20 March 2019)

IN THE HIGH COURT OF THE COOK ISLANDS CR NO 259, 261/19
HELD AT RAROTONGA
(CRIMINAL DIVISION)

POLICE

v

JOANNE BEVIN

Date: 20 March 2019

Counsel: Messrs K Bell & J Epati for the Crown
Mr D McNair for the Defendant

Sentence: 20 March 2019

SENTENCING NOTES OF HUGH WILLIAMS, CJ

[10:12:17]

[1] Ms Bevin, it has been a sorry episode for you. One which has obviously caused you considerable amount of stress. As you now realise it was foolish to give this chap his passport back particularly when you had been in Court and you knew the terms on which it was to be released.
[2] I can understand that you were overworked and overstressed at the time but you did have obligations to the Court arising out of the terms on which the passport was released.
[3] Given that your employer has paid the $3000, I will grant the Crown’s application to withdraw the attempted diversion of the course of justice charge, convict you on the contempt of Court but impose no penalty.
