High Court of the Cook Islands |
IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CRN 443/19
POLICE
v
RODNEY JOHN AKAVI NGATIKAO
Date: 8 August 2019
Counsel: Ms K Bell for the Crown
Mr N George for Defendant
DECISION ON BAIL OF DOHERTY J
[9:20:26]
[1] Rodney Ngatikao has been arrested and has been on remand for one week. He has been charged for possession of cannabis for the purpose of dealing. I dealt with his co-offender Mr Manu just before Mr Ngatikao was called and for the same reasons as I set out in the grant of bail for Mr Manu, I grant bail to Mr Ngatikao conditional upon a further one week remand.
[2] The remarks I made in relation to Mr Manu should be taken into account in this file and I will not repeat them.
[3] But on the basis that I granted the indulgences for Mr Manu, I do the same for Mr Ngatikao. He is remanded in custody until 10am on 15 August, that is one week from today, and thereafter he will be released on bail, to be back in this Court at 9am on 19 September.
[4] His conditions of bail are:
- That he not associate with Rhys Manu;
- That he not apply for a passport;
- That he surrender any other travel documents to the Registrar of this Court; and
- He is not to leave the island of Rarotonga without permission of this Court.
[5] Bearing in mind the reason that the remand is in custody for both of these gentlemen for the next week, I think that it is appropriate that I suppress the reasons for the request by police for that remand period, and that will apply to both of them.
[6] Thank you.
Colin Doherty, J
