High Court of the Cook Islands |
IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR NO'S 212, 213 & 214/12
POLICE
v
RONGOMATE PATRICK IVIRANGI,
TAIA JERMAINE SAMUELA,
TEATAI ARIKI JUNIOR TEATAI ARIKI
Hearing: 30 March 2012
Counsel: Mr Manavaroa for the Crown
Mr George for the Defendant
Sentence: 30 March 2012
SENTENCING NOTES OF THE HONOURABLE TOM WESTON CJ
[1] Mr Ivirangi, Mr Samuela, and Mr Ariki, you are here today for sentence having pleaded guilty to cultivation charges. I enter convictions on those.
[2] All three of you come with references and, like the previous defendants, I have the misfortune to sentence you. You are obviously people with talents and abilities and you have been let down by your own stupidity.
[3] As with the previous sentencing, I do not need to say a lot because I have dealt with it in sentencing Mr Tuakana, who was the instigator.
[4] I believe the appropriate sentence is that, for each of you, you are going to have 12 months probation, with the first 5 months to be served on community service.
[5] Each of you is to pay $30 Court costs.
[6] The terms of your Probation are that you will attend any courses that you are directed by Probation.
[7] You have got to talk to Probation either before you leave Court, or within the next 24 hours.
[8] As with the other defendants, and I echo what I have said already, and what Mr George has said, that we hope we never see you again, that this is a singular fall from grace and there will be no more. And again, with my Mauke connections, let me say personally I hope this is the only time that any of you ever come before this Court.
