Police v Puati [2011] CKHC 12; CR 578 of 2010 (11 March 2011)

IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)

CR NO. 578/2010

POLICE

V

JAMES PUATI

Hearing: 11 March 2011

Counsel: Mr T Manavaroa for Police
Mr T Arnold for Defendant

Sentence: 11 March 2011

SENTENCING NOTES OF HINGSTON J

T Manavaroa, Crown Law Office, Avarua, Rarotonga
T Arnold P.C., Rarotonga

[1] Mr Puati, I have taken on board what your counsel has said and, to a large extent, I do not disagree with the things he has said. The papers from the Probation Services confirm that I do not think a lecture on careless driving would be of any great purpose. You know that things went wrong and you were hurt.

[2] However, I do not believe that you should just walk away with the injuries you sustained etc or by just having to pay restitution. So I am going to convict you and fine you $500. I will not touch your licence.

[3] I make an Order that you pay the restitution as set out. You will pay that restitution, together with the fine, at the rate of $200 per month. Stand down.

Hingston J
