POLICE

V

ITO O TE RA MATAKINO

Hearing: 3 March 2010

Counsel: Sergeant Manavaroa for the Police
Ms Lavenia Rokoika for Accused

Sentence: 3 March 2010

SENTENCING NOTES OF HINGSTON J

[1] Well young man, you have heard the Police saying that you should get four years in jail. I have listened to your counsel and she is at the other end, saying that you should have probation or a non-custodial sentence – that you should not go to jail.

[2] I've looked very carefully at all the submissions and taking them into account the solutions this morning, I was looking at two years' imprisonment. Ms Ra has convinced me, not thot that you should not go to prison - but listening to her and the Police, I'm going to sentence you to one year's imprisonment follow 12 months supervision. Stand down.

Hingston J
