DECISION OF WESTON J
I have, before me, an application for bail. Ms Rokoika advanced submissions in support of, that but as it turned out, the Police did not oppose bail subject to conditions.
While the charge against the accused is a serious one, I have listened carefully to the submissions of both Ms Rokoika and the Police who believe that the accused does not present a risk of further offending of the sort alleged. Accordingly I order that he be released on bail subject to the following terms:
1. that he surrender his passport;
2. that he shall not consume or purchase alcohol or drugs;
3. that he is not to enter any licensed premises;
4. that he is not to approach the complainant or beset her in any way and neither is he to approach or beset any of the witnesses;
5. that a curfew is ordered between the hours of 7.00pm and 7.00am except for the purposes of the accused attending his place of work. Once he has finished his job he is to return immediately to his home.
