Police v Metuakore [2008] CKHC 33; CR758.08 (1 October 2008)

IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)

CR NO: 758/08

POLICE

v

TEARIKI PIAU METUAKORE
Defendant

Date:
01 October 2008
Counsel:
Senior Sergeant Manavaroa for Police

Mr. N George for Defendant

SENTENCE OF WESTON J

Mr. Metuakore, you are here before me for sentence in relation to a cannabis charge. There's a rather unusual history to this matter. You were first sentenced before a Justice of the Peace in Atiu. You were fined on that occasion $1,000.00 plus other consequences. It was then discovered that the Justice of the Peace did not have jurisdiction to deal with the matter.

I am satisfied that the amount of cannabis involved is very small. You have no previous record. You have pleaded guilty to this. In all the circumstances I believe an appropriate fine is the sum of $100.00 together with court costs of $30.00. So ordered.

Weston J
