IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR 1006/07
POLICE
V
Laszlo Sebastian Kajer
Defendant
Mr Howard for Police
Lavinia Rokoika for defendant
Date of hearing: 14 March 2008
SENTENCE OF HINGSTON J
Mr Kajer, I've listened to your counsel and the police and I note that in the circumstances the recommendation by the probation service of 12 months probation rather than a financial penalty, that type of sentence appeals to me because you may well be make involved in quite substantial financial payments if reparation is sought. I'm not going to make order for reparation because as your counsel mentioned has been tested there is no new evidence of the losses and I'm going to leave that aside and that can be followed up by the persons agreed in due course but not withstanding the suggestion that a financial penalty would be appropriate. I don't believe in a circumstances it is, I rather leave to what the prosecutor has suggested and I'm going to make an order to sentence you to 6 months community service followed by 12 months probation and in following the reasoning of your counsel I'm not going to touch you on the outonic matters but I will impose condition that you are to attend any training, workshop conducted by the probation services. On each of the charges and that can be served concurrently.
