Police v Carruthers [2007] CKHC 33; CR121.07 (3 September 2007)

IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)

CR NO: 121/2007

BETWEEN

POLICE

v

WILLIAM CURRUTHERS
Defendant

Date: 03 September 2007

Mr. Elikana for Police
Mr. McFadzien for Defendant

SENTENCE OF WESTON J

  1. Mr Carruthers, you are here today for sentence having pleaded guilty to the possession of a small amount of cannabis. The suggestion from your counsel is that it is not yours. That, however, is a matter I cannot resolve. The fact of the matter is that you have pleaded guilty to possession.
  2. Mr McFadzien has pointed out that this is your first offence. He has taken me through the run of cases over the last few years. He suggested that there should be a fine of $300. That coincides with my own thinking on the matter so you are fined the sum of $300.00 and Court costs of $30.00 in addition to that.
