Police v Dauvois [2006] CKHC 8; CR 393 of 2006 (20 October 2006)

IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)

CR NO. 393/06

BETWEEN

POLICE

AND:

WILFRED DAUVOIS

Sgt Howard for Police
Mr N George for Defendant

Date of Sentence: 20 October 2006

SENTENCE OF WESTON J

1. Mr Dauvois you are here today for sentencing on two willful damage counts which you have pleaded guilty to and I imagine you would be the first to agree that they arise out of a very stupid act on your part, probably a very embarrassing act and one that you wish really had not happened. But you have responded in what I think is a very responsible and mature way, by paying back a large amount of the money already and in my book that is a credit for you and your counsel has emphasized, as has the Probation Service, that you are a hardworking man and that, too, is a credit to you.

2. Quite a few of the people who appear here do not come with those advantages. So I am going to take those into account. Can I suggest that in the future that you try and deal with peer group pressure, you try and control alcohol and anger issues. Really you get to know yourself and you be strong in yourself because I think you can be.

3. I am going to order reparation, not for the rental car but just for the balance of what you owe which is the figure of $1385. I am not going to order any community service, so you will be able to work on your Saturdays and I expect you to get on and pay that back as soon as you can.

4. You will be sentenced to a period of 12 months probation starting now and it will be subject to these conditions and they are the conditions that are set out in the Probation report. You are to abstain from the purchase and consumption of alcohol during that time, not to enter licensed premises without the approval of the Chief Probation Officer and thirdly you are to attend any training workshop conducted by the Probation Service if they want you to go to that. But I suggest you look on this as a lesson well learnt and get on with your life, good luck to you.
