v

UTUTUTAVAKE PATIA
Defendant

Date of Sentence: 24 February 2006

Senior Sergeant Howard for Police
Mr. George for Defendant

SENTENCE OF HINGSTON J

Mr. Patia I take on board all what your counsel has told me and I too am sympathetic partly because you were put in a situation probably not of your own making. However, you had been drinking, that's admitted and you've also precipitated everything really by dragging your partner out of the house.

Mr. George has asked me to dispense with a custodial sentence. I am going to take the risk because you've already done as Mr. George says a month in prison; I hope it's been a lesson. I am going sentence you to, in each case, to two years probation with special conditions - you are to abstain from the consumption alcoholic liquor, you are not to go into any licensed premises where liquor is sold, you are also as Mr. George says, to continue at the direction of the Probation Officer to attend the Alcohol Rehabilitation Programme that you have taken on board.

H K Hingston
JUDGE
