SENTENCE OF HINGSTON J

I have read your letter and I notice that you have kept out of trouble for the last seven years other than drunken driving a couple of years ago. You are not in a position to pay the owners of the Tamarind Restaurant back. Now, you understand that the recommendation is that I sentence you to 12 months imprisonment and 12 months probation. Now read your letter, you tell me why, if you think there is a good reason why I should not follow that recommendation other than you don't want to go to jail, I know that. Okay, look I am going to follow that recommendation and I am going to sentence you to 12 months imprisonment on each charge as well as 12 months probation. The probation to commence after you are released and a condition of the probation is that you will serve it on the island of Aitutaki and live with your parents there, Mr. and Mrs. Samuel Senior. And for what it's worth I make an order that you are to repay the amount that you stole, the $3846.90. The sentences are concurrent.
