IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR 466/05, 475/05
POLICE
v
MOSE NGAPARE
Defendant
Date of Sentence: 24 February 2006
Sgt Howard for Police
Mr. Ngapare for himself
SENTENCE OF HINGSTON J
I am told in this report that you are already on probation for burglary and you have already breached the conditions, why was that? Don't you like probation? You realize that when the Court gives you probation it's a chance for you; otherwise - watch your fingers - in you go. Do you appreciate that? The Probation Service has suggested as you will read in that report that you be given another chance and that you serve your probation in Aitutaki with your natural parents, what do you think about, do you want to go back to Aitutaki. I am going to take a chance then and I will sentence you to 12 months probation and you are to live with your natural father in Aitutaki and serve your term of probation there. All I can say young man, if you come back before any other tribunal or Judge on similar offence I am sure you will be going for an unpaid holiday in jail. You understand that, so you have been given a chance, we will see how it goes.
H K Hingston
JUDGE
