Police v Heather [2006] CKHC 42; CR271.06 (20 October 2006)

IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)

CR NOS: 271/06

POLICE

v

GENE HENRY HEATHER
Defendant

Date: 20 October 2006

Counsel: Sgt Howard for Police
Mr. Gene Henry Heather, in person

SENTENCE OF WESTON J

  1. Mr Heather, you are here charged with unlawful taking and you are now to be sentenced for that.
  2. The Probation report sets out the circumstances of that. It also makes it clear that you have repaid a very large sum of money, being approximately $18,980 for the damage you caused to the car. That is greatly to your credit. That is a punishment way in excess of anything I can possibly add. So, I am going to discharge you without conviction.

Judge
