Police v Hewitt [2006] CKHC 41; CR404.06 (20 October 2006)
IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR NO: 404/06
POLICE
v
DANIEL HEWITT
Defendant
Date: 20 October 2006
Sgt Howard for Police
Mr. S Hood for Defendant
SENTENCE OF WESTON J
- Mr Hewitt, you are here for sentencing. You are here for the first time in this Court and, really, one gets the impression that you
are set on a course where you are wanting to keep coming back here in the future and get sentenced, which strikes me as being an
entirely stupid thing. But it is really up to you. If you want to keep coming back because you keep committing crimes, the Court
will deal with you.
- There are a couple of things in your Probation Report that seem to me quite positive. One is, you refer to the support you have had
from your family and your family talks about the embarrassment that you have caused them. Families are important and you want to
think about that and whether you are going to continue embarrassing them.
- The other thing that seems to be in your favour is that, when your friends went to the Central Motel, you refused, you stayed out.
I would like to think that is because you did not want to be involved in the theft. I see that some of your friends have said that
you were there as a lookout. I do not know, but I would like to think that you refused to go in.
- Anyway, as I say, it is a matter for you.
- I accept the recommendation of the Probation Service, that you should have a term of 18 months supervision. There are four terms
that are spelt out in the Probation report. I am going to adopt those without reading them out in full. Counsel has got a copy of
that.
